1. Anyone who becomes aware of elder abuse may report it to an institution specializing in protection of the elderly or an investigative agency.

 

2. A person who falls under any of the following subparagraphs, when he or she becomes aware of elder abuse against a person aged 65 or older in the course of performing his or her duties, shall immediately report it to an institution specializing in protection of the elderly or an investigative agency.

– Medical personnel and heads of medical institutions conducting medical business in medical institutions under Article 3 Paragraph 1 of the Medical Act

– Employees of services such as visit care, care, or safety checks under Article 27-2, heads of welfare facilities for the elderly and their employees under Article 31, and welfare counselors for the elderly under Article 7

– A person who conducts counseling, treatment, training, or nursing work for the elderly with disabilities at welfare facilities for persons with disabilities under Article 58 of the 「Act on Welfare of Persons with Disabilities」

– Heads and employees of domestic violence counseling centers and domestic violence victim protection facilities in accordance with Articles 5 and 7 of the 「Domestic Violence Prevention and Victim Protection Act」

– Public officials exclusively in charge of social welfare pursuant to Article 14 of the 「Social Welfare Services Act」, social welfare centers pursuant to Article 34 of the same Act, heads of facilities for the protection of vagrants and homeless persons, and their employees

– The head of a long-term care institution and its employees under Article 31 of the Long-term Care Insurance Act for the Elderly

– Paramedics of the 119 ambulance unit in accordance with Article 10 of the 「119 Rescue and First Aid Act」

– The head of a healthy family support center and employees in accordance with Article 35 of the 「Framework Act on Healthy Homes」

– The head of a multicultural family support center and employees in accordance with Article 12 of the 「Multicultural Family Support Act」

– Sexual violence victim counseling center under Article 10 of the 「Sexual Violence Prevention and Victim Protection Act」 and the head of sexual violence victim protection facility under Article 12 of the same Act and their employees

– Emergency medical technicians in accordance with Article 36 of the 「Emergency Medical Service Act」

– Medical technicians in accordance with subparagraph 1 of Article 1-2 of the 「Act on Medical Technicians, Etc.」

– Nursing staff belonging to the National Health Insurance Corporation in accordance with the 「National Health Insurance Act」

– Heads and employees of regional health and medical institutions in accordance with Article 2 of the 「Regional Health Act」

– Public officials in charge of installing and managing welfare facilities for the elderly under Article 31

 

3. The reporter’s identity must be guaranteed, and his identity must not be exposed against his will.

 

4. The head of the relevant central administrative agency shall include educational content related to elder abuse prevention and reporting obligations in the qualification acquisition course or refresher course for persons falling under any of the subparagraphs of paragraph (2), and the results thereof shall be reflected in the health and welfare programs. must be submitted to the Minister.

 

5. The head of each of the following agencies to which the person obligated to report elder abuse under paragraph (2) belongs shall conduct education on prevention of elder abuse and duty to report to the person obligated to report elder abuse, and submit the results to the Minister of Health and Welfare.

– Welfare facilities for the elderly under Article 31

– Nursing hospitals and general hospitals in accordance with Article 3 (2) 3 (d) and (e) of the 「Medical Service Act」

– Long-term care institutions in accordance with Article 2, subparagraph 4 of the 「Long-term Care Insurance Act for the Elderly」

 

6. Necessary matters concerning the content, time, method, etc. of education pursuant to paragraphs 4 and 5 shall be determined by Ordinance of the Ministry of Health and Welfare.

 

 

 

Elderly Welfare Act Enforcement Rules
Article 29-16 (Contents of Education for Persons Obligated to Report Elder Abuse, etc.)

 

 

1. Education under Article 39-6 Paragraphs 4 and 5 of the Act (hereinafter referred to as “elder abuse prevention education”) shall include the following matters:

– Act on Elder Abuse Prevention and Reporting Obligation

– How to report elder abuse

– Elderly Victims Protection Procedures

 

2. Elder abuse prevention education must be longer than 1 hour.

 

3. Elder abuse prevention education can be conducted using group education or Internet lectures.

 

 

 

Social welfare facilities must conduct at least 1 hour of training for those obligated to report elder abuse. Training can be conducted through group training or online lectures. Prevention and reporting tips and protection procedures specified in the 「Enforcement Rules of the Elderly Welfare Act」 are also required.
